Boat Monitoring PLC – Trial Participation & Liability Waiver
1. Purpose of Trial
You are participating in a limited trial of a prototype monitoring device (the “Solaris”) developed by Smithtek Pty Ltd (“Smithtek”). The Device is designed to monitor and transmit information such as bilge activity, battery status, and fuel level to a cloud dashboard accessible via phone or tablet.
2. Trial Status
The Device is currently in trial and evaluation stage. Performance, reliability, and data accuracy are still being assessed. The Device may experience interruptions, delays, or inaccuracies in readings or notifications.
3. Owner Responsibility
By signing this agreement, you acknowledge and agree that:
The Device is an aid to monitoring only, and does not replace regular physical inspection or maintenance of your vessel.
You remain solely responsible for the safe operation, inspection, and maintenance of your vessel and its systems, including but not limited to the bilge, batteries, and fuel systems.
You will not rely solely on the Device to prevent or detect faults, flooding, electrical issues, or other hazards.
4. Limitation of Liability
To the maximum extent permitted by law:
Smithtek and its officers, employees, and agents accept no liability whatsoever for any direct, indirect, incidental, consequential, or special loss, damage, injury, or expense (including but not limited to damage to the vessel, property, or the environment) arising from or in connection with the Device, its data, or its failure to operate correctly.
Participation in this trial is at your own risk.
Smithtek’s total liability, if any, shall be strictly limited to the replacement or refund of the Device.
5. Data & Communications
You acknowledge that:
The Device uses wireless or internet communications which may be subject to coverage limitations or network outages.
Data collected during this trial may be used by Smithtek for performance evaluation, technical improvement, and product development purposes.
6. Consent
By signing below, you confirm that you have read and understood this document, agree to the terms of participation, and release Smithtek Pty Ltd from all liability arising from your use of the Device.
